1. Purpose and scope

These terms govern the services supplied by Anastasija Canajeva — Entrepreneur individuel (the “Supplier”) to her client (the “Client”). They apply to every order, to the exclusion of any purchasing conditions of the Client, unless otherwise agreed in writing.

One rule governs every order, without exception: the work is delivered first and paid for afterwards. No deposit, no advance and no staged payment is requested, whatever the amount and whoever the Client is.

Two payment methods are available once the invoice has been issued: SEPA bank transfer, and a payment link on this site through which the Client settles the amount by card. The second exists because a transfer from outside the euro area is often slower and dearer; it changes the means of payment and nothing else.

Article 13 contains provisions that apply only to consumers. Where they conflict with anything else in these terms, they prevail.

2. What is not offered

No sworn or certified translation is provided. A sworn translation can only be produced by a translator listed as an expert with a French Court of Appeal, and the Supplier is not on that list. Where a document is intended for a préfecture, a court, a consulate or a university, the Client should confirm with that body which form is required before placing an order.

No spoken interpreting is offered. Where a request falls outside what the Supplier can deliver, this is said at the first exchange rather than after a quotation has been prepared.

3. Quotation and formation of the contract

Work priced per word is the subject of a written, free quotation setting out the scope, the language pair, the price and the delivery time. The quotation is valid for thirty (30) days.

The contract is formed on the date the Supplier receives the quotation accepted in writing; acceptance by email counts as writing. Any request outside the scope described is the subject of a further quotation and may move the delivery date.

4. Prices and turnaround

Website packUp to 1,500 words: home, services, about, contactFrom €200 / SEK 2,2505 working days

Packages are for one language pair and are quoted like any other work: a written quotation, then delivery, then the invoice. Beyond the word counts shown, the work is charged per word at the rates above. What each package excludes is stated in the quotation.

Per-word rates apply to the source text. Minimum invoice: €30 / SEK 340 per order. VAT not applicable, Article 293 B of the French General Tax Code.

Currencies. Every price is published in euros (EUR) and in Swedish kronor (SEK). The krona figures are fixed prices set in the catalogue, not conversions of the euro figures at the rate of the day; the two may therefore differ from the market rate. The Client chooses the currency when requesting a quotation or settling an invoice; that currency is the currency of the quotation, of the invoice, of the payment and of any refund, and it is not changed afterwards. The Supplier does not convert amounts.

5. Client obligations

The Client provides the source text in a workable format, states the language pair and the intended use, and names a contact able to answer questions of meaning. Where the Client has terminology it wants used, that list is provided before the work begins rather than after delivery.

The Client warrants that it holds the rights necessary to have the text translated and that the text does not infringe the rights of a third party.

6. Payment for work priced per word

This article governs payment for every order. The means of payment available are described in article 12.

No deposit is requested and nothing is payable before delivery. The invoice is issued after the work has been delivered and is payable within fourteen (14) days of its date.

Accepted payment methods are SEPA bank transfer and a secure payment link sent with the invoice, operated by an authorised payment services provider. No card data is entered on this site or retained by the Supplier.

Between businesses, late payment automatically incurs interest at the rate applied by the European Central Bank to its most recent refinancing operation plus ten percentage points, together with a fixed recovery indemnity of 40 €, under Article L441-10 of the French Commercial Code.

7. Delivery and acceptance

Delivery is by email in the agreed format. Turnaround runs from receipt of the complete source text and of any information needed to begin, not from acceptance of the quotation.

The Client has seven (7) days from delivery to report in writing any discrepancy against the agreed scope. Recognised discrepancies are corrected free of charge. After that period the delivery is treated as accepted.

8. What is a discrepancy, and what is not

A discrepancy is an error of meaning, an omission, a departure from agreed terminology, or a failure to respect the agreed format. These are corrected without charge.

The following are not discrepancies: a preference for a different turn of phrase where the translation is accurate; a change to the source text after the work began; terminology the Client did not supply in advance; or a use of the text different from the one stated at the outset.

9. Rights in the translation

A translation is a work in its own right under Article L112-3 of the French Intellectual Property Code, and copyright in it arises in favour of its author.

Economic rights in the translation are assigned to the Client for the legal term of protection and worldwide, on the date the price is paid in full. Until then the Client holds a mere right of use, revocable in the event of non-payment. The moral right of the author remains, as the law requires, inalienable.

Glossaries and terminology lists produced during the work are supplied to the Client and may be reused freely by them.

10. Confidentiality and handling of your text

Everything the Client sends is treated as confidential and is disclosed to no one. This obligation survives for five (5) years after the contract ends.

No text supplied by a Client is entered into an online machine translation service. Free online tools retain what is pasted into them, which would amount to disclosing the text to a third party. Where the Client asks for machine output to be assessed or corrected, that is a service in its own right and is priced as one.

Source files and delivered translations are kept for ninety (90) days after delivery so that a lost file can be reissued, then deleted. The Client may ask for immediate deletion at any point.

11. Liability, force majeure and governing law

The Supplier owes an obligation of means. Between businesses, liability is capped at the amount actually paid, excluding tax, for the work concerned, and excludes indirect loss. These limits do not apply in the event of gross or wilful misconduct, nor to a consumer Client.

Neither party is liable for a failure resulting from force majeure within the meaning of Article 1218 of the French Civil Code.

These terms are governed by French law. Failing amicable resolution, any dispute between businesses falls within the exclusive jurisdiction of the courts having jurisdiction over the Supplier's registered office.

Any complaint should be made in writing, by email to contact@canajeva.fr or by post to Anastasija Canajeva — Entrepreneur individuel, 1 rue de Rennes, 75006 Paris, France.

Receipt of any complaint is acknowledged within five (5) working days and a reasoned reply is given within thirty (30) days.

12. The payment link

12.1 What it is, and what it is not

This site offers a page through which a Client may settle, by card, an invoice for work that has already been delivered. It is not a shop and nothing is ordered through it. Paying starts no work, creates no contract for a new service, and confers no entitlement to a delivery.

A new Client must first request a quotation. The contract is formed as described in article 3, the work is delivered as described in article 7, and only then does an amount become payable.

12.2 How the amount is worked out

The amount is calculated from the service concerned, the number of words invoiced and the rate published in article 4, subject to the minimum invoice. The figure displayed on the page is recalculated by the site before payment is taken, so that a figure altered in the browser has no effect.

The calculator knows only the published rates. Where a reduced rate, a package agreed in advance or a partial delivery applies, the figure it produces will not match the invoice. In that case the Client should write to the Supplier rather than pay an amount they disagree with, and the invoice remains the reference in every case.

12.3 What is confirmed at the point of payment

Before paying, the Client accepts these terms and confirms, in a separate box that is never pre-ticked, that the payment settles work already delivered and that the service and word count shown match the quotation or invoice received. The wording accepted and the time it was accepted are stored with the payment.

No consent to begin work before the end of a withdrawal period is requested here, and none would make sense: the work is already done and the period ran from acceptance of the quotation, as described in article 13.

12.4 Payments made in error

A payment received without a corresponding delivery, or exceeding the amount actually due, is refunded in full to the same payment method, without the Client having to justify the request and at no cost to them. This is dealt with in the Refund and Cancellation Policy.

12.5 What the payment link is, technically

The payment link is a bank transfer carried out through the local payment method the Client's own bank provides — iDEAL, Bancontact, Swish, Trustly or an equivalent, depending on the country. The Client approves the payment inside their own banking environment; the funds move from their account to the Supplier's, as with any transfer.

What it adds is the handling. The service, the number of words and the reference travel with the payment, so it is reconciled on arrival and the invoice is closed the same day rather than after a manual search. An ordinary SEPA transfer remains available at all times and is neither slower to accept nor treated differently.

The payment is made in the currency of the invoice, euros or Swedish kronor, at the fixed rate published for that currency; nothing is converted by the Supplier. Which methods are available for a payment in kronor depends on the provider.

Payment is processed by an authorised payment services provider. No card number or bank credential is entered on this site and none is retained by the Supplier, who receives only the amount, the currency, the status and a reference. Which methods are offered depends on the country of the Client's bank and on the provider, and no particular method is guaranteed to be available.

13. Provisions applicable to consumer Clients

13.1 Pre-contractual information

Under Article L111-1 of the French Consumer Code, the consumer Client receives, before the contract is concluded and in a legible manner, the essential characteristics of the service, its price, the date or period of performance, the identity and contact details of the Supplier, and information on statutory guarantees. These appear on the service pages, in the quotation and in these terms.

13.2 Right of withdrawal

A consumer Client concluding the contract at a distance has fourteen (14) days from its conclusion to withdraw, without giving reasons and without penalty other than as provided in 13.3, under Article L221-18 of the French Consumer Code. To exercise this right, the consumer sends an unambiguous statement to the contact details shown at the top of this page. A withdrawal form is made available; its use is not compulsory.

13.3 Performance before the end of the period

Turnaround times of 24 to 48 hours are shorter than the fourteen-day period. The Supplier therefore begins work before that period expires only at the express request of the consumer Client, recorded on a durable medium when the quotation is accepted. That request is not collected on the payment page, which concerns work already delivered.

Withdrawal during performance. If the consumer withdraws after making that request, they remain liable, under Article L221-25 of the French Consumer Code, for an amount proportionate to what has been supplied up to the point the decision was communicated, measured against the total price. That amount is calculated on the volume actually worked on and is set out in a written statement before it is invoiced.

Loss of the right of withdrawal. Under Article L221-28, 1° of the French Consumer Code, the right of withdrawal cannot be exercised where the service has been fully performed before the end of the fourteen-day period and performance began after the consumer's express request and acknowledgment that the right would be lost once the contract was fully performed. That acknowledgment is collected separately from the acceptance of the quotation and is recorded on a durable medium.

A consumer who prefers to keep the full fourteen days should say so: nothing is started and work begins once the period has run. Because no payment is taken before delivery, waiting costs nothing but time.

13.4 Statutory guarantees

The consumer Client benefits by operation of law from the guarantees provided by the French Consumer Code and Civil Code, including the statutory guarantee of conformity applicable to services. Enforcing them is free of charge.

13.5 Complaints and jurisdiction

Any complaint should be made in writing, by email to contact@canajeva.fr or by post to Anastasija Canajeva — Entrepreneur individuel, 1 rue de Rennes, 75006 Paris, France.

Receipt of any complaint is acknowledged within five (5) working days and a reasoned reply is given within thirty (30) days.

The consumer Client may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they were resident when the contract was concluded or when the harmful event occurred.
